According to a complaint filed in Mille Lacs County District Court, on or about June, 29, 2010, Tribal Police were dispatched to the intersection of Wakadaaki Drive and Zhingwaak Drive for a one vehicle rollover. Officers were told that Donovan Lee Davis, had been the driver of the vehicle but was no longer at the scene.
An arrest and detention order had previously been issued on Davis by the Department of Corrections and they were looking for Davis. The tribal officer and investigator spoke to Dawn Marie Day and inquired about Davis’ whereabouts and the whereabouts of Marlow James Day. She was advised that both Davis and Marlow Day had fugitive warrants from the Department of Corrections. Dawn Marie Day denied knowing where either man was. The officers advised Day that harboring fugitives is a crime. The officers had received information that Marlow Day and Davis were living with Dawn Marie Day. On July 14, the tribal investigator along with assistance from other agencies located Davis and Marlow Day at Dawn Marie Day’s apartment. She was present with the fugitives in her apartment and was placed under arrest. Marlow Day was still wearing an ankle bracelet when he was found in Dawn Marie Day’s apartment. Dawn Marie Day has been charged with one count of aiding an offender to avoid arrest. The maximum penalty for the charge is three years imprisonment and a $5,000 fine.
